Mossack Fonseca - De acuerdo con datos de la Dirección General de Ingresos (DGI) del Ministerio de Economía y Finanzas, el incumplimiento en la declaración y pago del Impuesto sobre la Transferencia de Bienes Corporales Muebles y la Prestación de Servicios (Itbms) supera el 40%, lo cual se traduce en una pérdida de recaudación de unos $500 millones al año.
Por tal razón, durante el año 2015, se aprobó el Decreto Ejecutivo No. 463 “Que modifica el Decreto Ejecutivo No. 84 de 26 de agosto de 2005 “Que reglamenta las disposiciones del Impuesto a la Transferencia de Bienes Corporales Muebles y la Prestación de Servicios, con el objeto de ampliar los mecanismos de retención”. Con este paquete de medidas, se busca mejorar el cobro del impuesto de Itbms y aplicar en Panamá buenas prácticas internacionales de administración tributaria implementadas con éxito en otros países de Latinoamérica. Principales cambios que incorpora el Decreto No. 463: Se mantiene la retención ya existente sobre el 50% del Itbms de los proveedores del Estado, pero ahora sin importar el monto del contrato (antes la contratación debía superar los $20.000,00). A partir del 1 de noviembre de 2015, se convierten en agentes retenedores del Itbms: 166 empresas que adquieren bienes y servicios por $10.000.000,00 o más cada año, las cuales tendrán que retener el 50% del Itbms a sus proveedores e ingresarlo al fisco. Por su parte, los proveedores tendrán el derecho al crédito fiscal por el monto retenido por adelantado. Las entidades administradoras de tarjetas de débito y crédito, encargadas de realizar pagos a comerciantes y prestadores de servicios en general, en el momento del pago o abono en cuenta de las personas o establecimientos afiliados. Esta retención será del 50% del Itbms causado, sin embargo, durante el primer año contado a partir del 1 de noviembre de 2015, dicha retención será del 2% sobre el total de las transacciones de ventas de bienes o prestación de servicios gravados. Vencido este término, se deberá aplicar la retención en la fuente del Itbms. Obligaciones de los Agentes de Retención: Liquidar y pagar la retención, presentar informes y reportes de los sujetos y valores retenidos, en la misma fecha de presentación de la declaración mensual de Itbms. Expedir certificados por las retenciones realizadas en el mes a los proveedores o establecimientos a fin de que esos puedan utilizarlos para documentar los respectivos créditos fiscales en su declaración jurada del Itbms. Condiciones para que opere la retención del Itbms en la fuente: Que se realice el pago o acreditamiento del precio, parcial o total. Que el pago corresponda a una operación gravada con el Itbms. Que la persona que realice el pago haya sido designada como agente de retención. Que el beneficiario del pago no sea una entidad estatal ni un agente de retención designado por la DGI. Cabe señalar que cuando la operación sujeta a retención se realiza entre agentes de retención del Itbms, no se practica la retención en la fuente. Esta normativa aplica sólo a compras locales, no a importaciones. El pasado martes 1 de marzo, en el Colegio Nacional de Abogados de Panamá, se hizo la presentación oficial de la Revista Lex, en su edición 2016.

Mossack Fonseca - On February 18, 2016, the Financial Action Task Force (FATF) announced that Panama is no longer on the gray list of non-cooperative countries. As per the FATF, the gray list is comprised of jurisdictions with “strategic deficiencies in anti-money laundering / countering the financing of terrorism measures”.
The FATF agency review group recognized the significant progress made by Panama in improving its anti-money laundering (AML)/countering the financing of terrorism (CFT) measures, and noted that they have established legal and regulatory frameworks to accomplish their commitments in their action plan regarding the strategic deficiencies that the FATF had identified in June 2014. As a result of the FATF’s findings, Panama is no longer subject to their monitoring process. In May of 2014, Former Panama Finance Minister Frank De Lima said in a forum organized by the publication ANPanama that the country would be included on the gray list, without having the time necessary to make any substantive changes. It only took a year and a half for Panama to complete the complex legal and regulatory (e.g., Law 23 of April 17th, 2015) changes necessary to exit the gray list. As part of the new law and regulations, an administrator was appointed who is responsible for supervising the nonfinancial individuals and companies who are obligated to comply with the law and the professionals already subject to supervision with regard to money laundering, terrorism financing, and the financing of weapons of mass destruction. Over 21 correspondent banks in Panama were dropped due to their inclusion on the FATF gray list. In addition, the country has been training the personnel who work in the relevant supervisory institutions on the implementation of the measures required by the FATF.
